Tobacco Compliance Checks

Area law enforcement agencies, with assistance from Fargo Cass Public Health, conduct tobacco compliance checks. When an establishment fails, the following penalties apply:

Fargo:
The 1st failure in a one year time period – one year probation.
The 2nd failure in a one year time period – 3 day suspension of the tobacco license.
The 3rd failure in a one year time period – 10 day suspension of the tobacco license.

West Fargo:

With no approved training program:

1st offense----written warning, 12 month probationary period.
2nd offense---3 day suspension of license (if within probationary period).
3rd offense---10 day suspension of license (if within probationary period).
Subsequent violations within probationary period result in a 30 day license suspension.
If any sales occur during a suspension period, the license will be suspended for the full probationary period.

With an approved training program:

1st offense---written warning, 12 month probationary period.
2nd offense---$250 administrative fine (if within probationary period).
3rd offense---$250 administrative fine (if within probationary period).
4th offense---3 day suspension of license (if within probationary period).
5th offense---10 day suspension of license (if within probationary period).
Subsequent violations within probationary period result in 30 day suspension.

February 26, 2014

The Fargo and West Fargo Police Departments, with assistance from Fargo Cass Public Health, conducted tobacco compliance checks.  In Fargo, 60 businesses were checked, seven failed.  In West Fargo, 11 businesses were checked, all passed.

Stop-n-Go #427, 1401 S. University Dr. – 1st fail in a 12-month period
Walgreen’s #11552, 4201 13th Ave. S. – 1st fail in a 12-month period
M&H, 1602 Main Ave. – 2nd fail in a 12-month period
Stop-n-Go #436, 204 42nd St. S. – 2nd fail in a 12-month period
Fargo South Pointe, 3202 33rd St. S. – 2nd fail in a 12-month period
Hornbacher’s #687, 1532 32nd Ave. S. – 2nd fail in a 12-month period

December 3, 2013

On Tuesday, December 3, the Fargo and West Fargo Police Departments, with assistance from Fargo Cass Public Health, conducted tobacco compliance checks. In Fargo, 65 businesses were checked, two failed.  In West Fargo, 11 businesses were checked, two failed.

Failed in Fargo:
Cenex, 4350 13th Avenue South – 1st fail in 12-month period
Holiday Station Store, 1902 45th Street South – 1st fail in a 12-month period

Failed in West Fargo:
Sooper Stop, 620 Sheyenne Street – 1st fail in a 12-month period
RJ’s Tesoro, 2125 Sheyenne Street– 1st fail in a 12-month period

September 18, 2013

On Wednesday, September 18, the Fargo and West Fargo Police Departments, with assistance from Fargo Cass Public Health, conducted tobacco compliance checks.  In Fargo, 63 businesses were checked, seven failed.  In West Fargo, eleven businesses were checked, two failed.

Petro Serve USA, 2903 Main Avenue – 1st fail in 12-month period
Petro Travel/Fuel Store, 4510 19 Avenue South – 2nd fail in a 12-month period
Stop-n-Go, 204 42 Street South – 1st fail in a 12-month period
West Acres All Stop Amoco, 3441 13th Avenue South – 2nd fail in a 12-month period
Fargo South Pointe, 3202 33 Street South – 1st fail in a 12-month period
Holiday Station Store, 2755 Brandt Drive South – 1st fail in a 12-month period
Stop-n-Go, 602 23rd Street South – 1st fail in a 12-month period

Failed in West Fargo:
Petro Serve USA, 239 Main Avenue West – 1st fail in a 12-month period
West Fargo Truck Stop, 1021 Main Avenue West – 1st fail in a 12-monthe period


August 8, 2013

On Thursday, August 8, the Cass County Sheriff’s Department, with assistance from Fargo Cass Public Health, conducted tobacco compliance checks.  In Cass County, 15 businesses were checked and one failed.

Failed in Cass County:
West Central Ag Services, Harwood

A tobacco compliance failure in Cass County is considered an infraction and the penalty is imposed by the court.

May 28, 2013

On Tuesday, May 28, the Fargo and West Fargo Police Departments, with assistance from Fargo Cass Public Health, conducted tobacco compliance checks. In Fargo, 52 businesses were checked, three failed.  In West Fargo, 12 businesses were checked, none failed.

Failed in Fargo:
Stop-n-Go, 1462 N. Broadway – 1st fail in 12-month period.
Ramada Plaza Suites, 1635 42nd St. S. – 1st fail in a 12-month period.
Stop-n-Go, 2002 25th St. S. – 2nd fail in a 12-month period.

March 19, 2013

On Tuesday, March 19, the Fargo and West Fargo Police Departments, with assistance from Fargo Cass Public Health, conducted tobacco compliance checks. In Fargo, 57 businesses were checked, eight failed. In West Fargo, 12 businesses were checked, none failed.

K-Mart, 2301 South University Drive – 1st fail in a 12-month period

Hornbacher’s, 1532 32nd Avenue South – 1st fail in a 12-month period
Petro Serve USA #088, 205 NP Avenue –1st fail in a 12-month period
