Regular Meeting:                         Wednesday:                         August 13, 2008:

The Regular Meeting of the Board of Planning Commissioners of the City of Fargo, North Dakota, was held in the City Commission Room at City Hall at 8:00 o'clock a.m., Wednesday, August 13, 2008.

The Planning Commissioners present or absent were as shown following:

Chair Paulsen called the meeting to order.

Item A:           Approve Order of Agenda

Chair Paulsen noted the addition of Item D concerning maintenance of trees, the continuation of Item Nos. 2, 10a, and 10b to September 10, 2008 and the continuation of Item Nos. 3 and 4 to October 8, 2008.  Mr. Vigesaa moved to approve the Order of Agenda as amended.  Second by Mr. Morrau.  All Members present voted aye and the motion was declared carried.  

Item B:           Minutes:  Regular Meeting of July 9, 2008

Ms. Ulferts-Stewart moved to approve the minutes of the July 9, 2008 Planning Commission meeting.  Second by Mr. Vigesaa.  All Members present voted aye and the motion was declared carried.

Item C:           Proposed Text Amendment:  Vacation of Right-of-Way and Easement Extinguishment Presentation by Jim Hinderaker

Mr. Hinderaker reviewed the City’s current process as well as ND Century Code requirements for right-of-way vacations and easement extinguishments.  He distributed copies of a draft Land Development Code amendment addressing vacation of right-of-ways.   

Extra Item:

At the request of Chair Paulsen, Nicole Crutchfield gave a summary of discussions held and concerns raised at a recent meeting City of Fargo staff held with the Roosevelt neighborhood regarding the proposed University Mixed-Use (UMU) District.  She said staff has requested the item be continued to October 8, 2008 in order to establish district boundaries, address parking issues, and work with the neighborhood to address their concerns.  Ms. Crutchfield gave a power point presentation created by the Roosevelt Neighborhood Executive Board outlining their recommendations for the UMU Zoning District including parking, design standards, zoning, communication, a neighborhood plan update, trees, and landscaping.  Ms. Crutchfield stated more time is needed to communicate the vision and make sure everyone - the neighborhood, NDSU, and the City of Fargo is on the same page.

Item D:           Discussion on south side tree removal led by Dan Dabbert and Jim Hinderaker

Jim Hinderaker noted the Planning Commission is sensitive to recognizing the value of trees.  He addressed the issue of trees and foliage removed in the Town Square Village Addition at the northwest corner of 40th Avenue and 42nd Street South.  Mr. Hinderaker stated there was not any tree worth saving in respect to size as they were not mature.  He noted there is a 50’ landscape buffer within the addition to preserve trees and serve as a transition.   

Don Dabbert Jr., property owner, stated he acquired the property because of the trees.  He continued by saying not long after acquiring the property, he worked with City of Fargo engineering staff on drainage and found the highest part of the lot needed to be at the back where the trees were located.  He said he had several arborists out to look at options and solutions to save the trees as it was in his best interest to save them, but unfortunately, they were not mature enough to save and relocate.

At 8:52 a.m., the Board recessed until the 9:00 o’clock a.m. scheduled Hearings.

(9:00 a.m.) A Hearing had been set for April 9, 2008 on a petition requesting a zoning change on portions of Section4, Township 138 North, Range 49 West.

At the April 9, 2008 meeting, the Hearing was continued to May 14, 2008.  

At the May 14, 2008 meeting, the Hearing was continued to June 11, 2008.

At the June 11, 2008 meeting, the Hearing was continued to this date and hour.  

Jim Hinderaker reviewed the staff report for the proposed zoning change stating, as submitted, staff is recommending denial of the GC, General Commercial request.  However, he stated if the General Commercial zone request is reduced to a Limited Commercial classification with the establishment of a Conditional Overlay, staff recommends approval.  He stated the Petitioner’s representative was in agreement with staff’s recommendation of a reduction in zoning with a conditional overlay, but was concerned with height limitations on the northwest 40 acres of the subject property.  As a result, he said, staff met with the Petitioner to modify the request.  He stated the approval criteria have been met and staff is recommending approval.

The Petitioner’s representative declined commenting on the application.  

Ms. Ulferts-Stewart moved the findings and recommendations of staff be accepted and approval be recommended to the City Commission of a reduction to the proposed zoning change as outlined within the staff report on the basis that it satisfactorily complies with the Comprehensive Plan, Standards of Section 20-0906.F (1-4) and all other applicable requirements of the Land Development Code.  Second by Mr. Morrau.  On call of the roll Members Vigesaa, Ulferts-Stewart, Palmes, Morrau, Slagle, and Paulsen voted aye.  Absent and not voting:  Members Fremstad, Ruth, and Wiley.  The motion was declared carried.

The Petitioner declined commenting on the application.  

Mr. Vigesaa moved the findings and recommendations of staff be accepted and approval be recommended to the City Commission of the R.D.O. Second Addition plat, as outlined within the staff report, as the proposal complies with the adopted Area Plan, the standards of Article 20-06, and all other applicable requirements of the Land Development Code.  Second by Mr. Morrau.  On call of the roll Members Ulferts-Stewart, Palmes, Vigesaa, Morrau, Slagle, and Paulsen voted aye.  Absent and not voting:  Members Fremstad, Ruth, and Wiley.  The motion was declared carried.

Item 6:            Hearing on a Petition requesting a Zoning Change from SR-3, Single-Dwelling to LC, Limited Commercial with a Conditional Overlay on Lot 6, less highway right-of-way, Block 8 of Aldrich & Roberts Addition, and from LC, Limited Commercial to LC, Limited Commercial with a Conditional Overlay on Lot 7, less highway right-of-way, Block 8 of Aldrich & Roberts Addition.  (Located at 1221 and 1225 University Drive South) (Carl T. (9:03 a.m.) Nicole Crutchfield reviewed the staff report for the proposed zoning change.  She distributed copies of a letter she received from Dawn Morgan, Jefferson Area Neighborhood Association President, stating the primary concerns outlined in the letter are the removal of housing and commercial encroachment into the residential neighborhood.  Ms. Crutchfield stated staff believes the review criteria have been met and is recommending approval.  

In response to Ms. Morgan’s letter, Carl Knudson, Petitioner, said the house was demolished because it was in poor repair.  He also stated there will not be any parking on University Drive.

Curtis Knudson, Petitioner’s father, reiterated that the demolished house was in poor shape and would have cost more to repair than it was worth.  

In response to a question by Ms Ulferts-Stewart, Ms. Crutchfield stated parking on University would require an access point which not easily attained.  She said the City of Fargo Traffic Engineer stated the current access point will have to be maintained.

Steven Stremick, adjacent property owner, stated his support for the proposal.  

Ms. Ulferts-Stewart moved the findings and recommendations of staff be accepted and approval be recommended to the City Commission of the zoning change from SR-3, Single-Dwelling to LC, Limited Commercial with a Conditional Overlay on Lot 6, less highway right-of-way, Block 8 of Aldrich & Roberts Addition; and from LC, Limited Commercial to LC, Limited Commercial with a Conditional Overlay on Lot 7, less highway right-of-way, Block 8, of Aldrich & Roberts Addition on the basis that review criteria of Section 20-0906.F (1-4) have been met.  Second by Ms. Palmes.  On call of the roll Members Morrau, Vigesaa, Ulferts-Stewart, Palmes, Slagle, and Paulsen voted aye.  Absent and not voting:  Members Fremstad, Ruth, and Wiley.  The motion was declared carried.

Item 7:            Hearing on a Petition requesting a Zoning Change from MR-3, Multi-Dwelling to GO, General Office on Lot 1, less the south 65 feet of the west 330 feet and less a portion platted as Mehl 2nd Addition of Block 1 of Mehl First Addition. (Located at 3401 25th Street South) (Robert A. Ona):  DENIED

(9:21 a.m.) Mark Williams presented the staff report for the proposed zoning change.  He noted two letters of concern were received citing concerns regarding signage and increased alley traffic.  Mr. Williams distributed copies of a protest petition requesting denial of the zoning request.  He stated staff is recommending approval as the request meets all outlined requirements.  

Dale Olsen, First Assembly of God Board member, stated the church plans to relocate the alley access off of 25th Street South to a new approach directly across from 34½ Avenue South.  He said one of the reasons for the zone change request is to construct an LED sign to increase the church’s visibility, and noted it will be dimmed by a photo cell and shut off at 10:00 pm.  He further stated the church plans to add a daycare.  Mr. Olsen presented current and proposed layouts of the facility to the Board.

Planning Director Jim Gilmour stated the City of Fargo Sign Code limits churches to 64 square feet of signage regardless of the zoning district.  He said staff will need to look at the Sign Code and consider if any institution in an office zone should be able to have the same amount of signage whether it is a church or another use.  He stated, before electronic signs are approved for any zone district, staff will also need to work on proposed ordinance changes to the Sign Code to address issues such as how bright the signs can be, when they need to be dimmed, flashing, and whether or not they will be a distraction to neighborhood.  He stated it is appropriate to have more strict limitations upon signage in a residential area.  

Chair Paulsen noted the Board can act only upon the zoning change today, not upon the signage.

Senior Pastor Robert Ona, Petitioner, presented a layout of a preliminary sign and stated they feel this is an appropriate time to consider signage as parking issues are addressed.  He stated he is willing to work with the City of Fargo to address signage and respects that the sign cannot be a distraction to drivers.  He said he understands the Board is not approving signage today and feels it is preliminary to conduct neighborhood meetings as this project is in the zoning phase.  He said neighborhood meetings will be held at the appropriate time.  

Mark Williams said he would like to clarify a comment made earlier in the Hearing.  He stated a daycare within a church is considered an accessory use and is allowed by right within MR-3, Multi-Dwelling zoning to have over 13 children.  He stated staff is recommending approval of this request because it is compatible and the transition to the arterials and collectors calls for a zoning change such as this.  He said he and staff have spent a great deal of time researching ideas and concepts for a proposal for LED signs adjacent to residential areas that are good for the community and legally defensible.    

Gregg Robbins, 2622 34th Avenue South, stated he wants more communication between the neighborhood and church.  He stated his concerns regarding lighting issues, safety, and alley traffic.  Mr. Robbins stated his support of the proposed daycare, and questioned why a zone change to General Office is needed when daycare facilities are allowed under the current MR-3, Multi-Dwelling zoning classification. 

In response to a question posed by Mr. Robbins, Mr. Gilmour stated a hearing, with opportunity for public comment, will be held at the time a sign ordinance is proposed.  He said the hearing will not address specific signs.  

Mr. Robbins stated a protest petition was signed by 41 people who do not want any changes made.  He said the people are concerned about safety and have issues with cars exiting the alley at a fast speed.  He questioned if the access points could be closed off.

Mr. Slagle questioned the reason for a zone change request if the sign portion of the application is to be set aside and the current zoning allows daycare centers with more than 12-13 children.  He noted it appears that the zone change request drives at signage.  

Mark Williams stated that although he is not aware of other reasons for the rezoning request, transitionally, General Office zoning fits with this area.  He noted MR-3, Multi-Dwelling zoning allows 35% building coverage while General Office zoning allows 65% building coverage.  He stated General Office zoning allows LED signage and said, if the Board is concerned with that, an overlay may be considered.

Terry Coldwell stated his concerns regarding the project.  

Pastor Ona stated they have worked with City of Fargo staff to address traffic issues.  He stated he feels a General Office zoning classification would be better for canopies for drop-offs as well as a better ingress to the facility.  He said they would like to max out the facility in the future, which would be better accomplished by the proposed zoning. He stated his desire to be a good neighbor and noted they are addressing Mr. Robbins’ lighting requests.  He explained the need to address safety issues through lighting also.

Mr. Slagle said General Office zoning would allow the applicant flexibility; however, he is hesitant to approve this without a better idea of the applicant’s master plan.  He stated his concern about alley traffic.  

There was discussion regarding alley traffic and use.

In response to a question by Ms. Ulferts-Stewart, Mark Williams stated religious institutions are allowed in all zoning classifications, but fit best in General Office or General Commercial.

Mr. Morrau stated, with the concerns of the neighborhood being what they are, he does not see the need for rezoning when the request is uncoupled from the sign issue.  He said he believes there is not quantitative data to support the zone change.  

Mr. Morrau moved to deny the proposed zoning change on the basis that approval criteria number one, the requested zoning change being justified by a change in conditions, has not been met.   Second by Ms. Palmes.  On call of the roll Members Morrau, Ulferts-Stewart, Palmes, Vigesaa, Slagle, and Paulsen voted aye.  Absent and not voting:  Members Fremstad, Ruth, and Wiley.  The motion was declared carried.

(9:16 a.m.) Mr. Hinderaker presented the staff report for the proposed plat and noted, since the subject property is outside of the corporate limits of the City of Fargo, the vacation cannot be approved by the City of Fargo.  He said staff has contacted the Reed Township Board of Supervisors and the petitioner’s representative stating the vacation must be reviewed and considered for approval by the Township.  Mr. Hinderaker stated staff is recommending approval on the plat of North 81-20 Second Subdivision.  

The Petitioner declined commenting on the application.

This was the time and date set for Hearings on petitions requesting a plat of Riverwood 1922 Second Addition and vacation of part of 10th Street North between the proposed plat of Riverwood 1922 Second Addition and 48th Avenue North; however, the staff has requested the Hearings be continued to September 10, 2008 to allow time to receive flood protection plans.

Item 11:         Hearing on a Petition requesting a Zoning Change from SR-3, Single-Dwelling to SR-4, Single-Dwelling on Lots 1 through 16, and 18 through 29, Block 5; and Lots 1 through 24, Block 6, Prairie Grove First Addition.  (Located at 2553 through 2685 54th Avenue South, and 2554 through 2634 55th Avenue South) (Michael Domitrovich):  APPROVED

(10:18 a.m.) Mr. Williams presented the staff report for the proposed zoning change and stated staff is recommending approval.  

The Petitioner declined commenting on the application.

Mr. Vigesaa moved the findings of staff be accepted and approval be recommended to the City Commission of the proposed zoning change from SR-3, Single-Dwelling to SR-4, Single-Dwelling on the basis that it satisfactorily complies with the Comprehensive Plan, Standards of Section 20-0906.F (1-4) and all other applicable requirements of the Land Development Code.  Second by Ms. Ulferts-Stewart.  On call of the roll Members Morrau, Palmes, Vigesaa, Ulferts-Stewart, and Paulsen voted aye.  Absent and not voting:  Members Fremstad, Ruth, Slagle and Wiley.  The motion was declared carried
